Decree detailing the amended Law on Product and Goods Quality

On January 23, 2026, the Government issued Decree No. 37/2026/ND-CP to provide guidelines for the Law on Product and Goods Quality. Previously, on June 18, 2025, the National Assembly passed and enacted the 2025 Amended Law on Product and Goods Quality (No. 78/2025/QH15), which contains numerous amendments to the current Law No. 05/2007/QH12.

Classification of products by risk level

The Decree stipulates the principles for determining the risk level of products and goods as follows:

  • Based on scientific evidence and data applied in practice;
  • The capacity of state agencies to manage such matters during each period;
  • Ensuring transparency, objectivity, and adherence to the principles of product and goods quality management;
  • Ensuring the principle of proportionality, whereby state management requirements must be commensurate with the risk level;
  • Applying the precautionary principle in cases where there is a serious risk to human health, life, the environment, or national security, even if there is insufficient scientific evidence.

Under the amended Product and Goods Quality Law of 2025, products and goods are classified into three risk categories: low, medium, and high. The Decree specifies this matter as follows:

  • High-risk category: products and goods with a high level of harmful risk and a high probability of risk occurrence, which may cause serious or particularly serious consequences if appropriate management measures are not in place;
  • Medium-risk category: products and goods with a moderate level of risk or a moderate likelihood of risk occurring, which may cause significant harm if appropriate management measures are not in place;
  • Low-risk category: products and goods with a low level of hazard risk or a low probability of risk occurrence, which are unlikely to cause significant impacts under normal control or usage conditions.

Product and Goods Traceability

  • Product and goods traceability data provided for entities to access via the national product and goods traceability portal must include, at a minimum, the following information:
  • Product or goods name;
  • Product or goods image;
  • Name of the manufacturing or trading entity;
  • Address of the manufacturer or business;
  • Origin of the product or goods;
  • Brand, trademark, batch number, or product serial number (if applicable);
  • Expiration date of the product or goods (if applicable).

Based on the principles for determining the risk level of products and goods, sectoral and industry management agencies shall identify a list of products and goods with high risk levels and establish a mandatory timeline for implementing traceability.

Electronic Product Labels

Manufacturers and businesses have the right to decide whether to use electronic product labels. The content to be included in the electronic label is specified as follows:

  • For goods with a low risk level, the organisations or individuals responsible for labelling the goods may use an electronic label to display all required information as prescribed.
  • For goods with medium or high risk levels, the following information must be displayed on the physical label:
  1. Product name;
  2. Name and address of the organisation or individual responsible for the product;
  3. Country of origin; (If the country of origin cannot be determined, indicate the location where the final production step to complete the product was performed.)
  4. Warning information;
  5. Other required information may be displayed via an electronic label.

Electronic labels must be registered in the National Database on Electronic Labelling. The procedure for registering electronic labels is set forth in Article 54 of this Decree.

Content and Method of Product Labelling

The regulations on mandatory content and labelling methods generally inherit the current provisions on product labelling under Decree 43/2017/ND-CP and Decree 111/2021/ND-CP.
