2. Requirements Regarding Mandatory Health Examination Frequency and Scope

In addition to complying with report submission deadlines, businesses must ensure that health examinations are conducted at the legally prescribed frequency and cover all mandatory examination items.

2.1. Health Examination Frequency Under Article 21 of the 2015 Law on Occupational Safety and Health

  • General employees: Health examinations must be organized at least once a year.
  • Employees in special categories: Employees performing heavy, hazardous or dangerous work; employees with disabilities; minor employees; and elderly employees must undergo health examinations at least once every 06 months (i.e. twice a year).

2.2. Mandatory Examination Items Under Circular No. 32/2023/TT-BYT and Circular No. 25/2026/TT-BYT

Employees' health examination records must include all of the following examination items:

  • Physical examination: Measurement of height, weight, body mass index (BMI), pulse rate and blood pressure.
  • Comprehensive clinical examination: Internal medicine, surgery, ophthalmology, ear, nose and throat (ENT), dentistry and maxillofacial examination, and dermatology.
  • Paraclinical examinations: Laboratory tests and diagnostic imaging procedures performed in accordance with the physician's professional assessment and instructions.
  • Obstetric and gynecological examination: This is a mandatory examination item specifically for female employees. Employers must not arbitrarily remove or reduce this examination item.

3. Administrative Penalties for Businesses Violating Health Examination Requirements

Late submission of reports or failure to organize periodic health examinations for employees may result in strict administrative penalties under Decree No. 283/2026/ND-CP.

  • Direct monetary fines: Pursuant to Clause 2 and Point a, Clause 11 of Article 33 of Decree No. 283/2026/ND-CP, businesses are subject to fines ranging from VND 1,000,000 to VND 3,000,000 for each employee who has not undergone a health examination. The total fine for a single violating establishment may reach a maximum of VND 75,000,000.
  • Remedial measures: In addition to paying the administrative fine, businesses are required to arrange supplementary health examinations for the affected employees or reimburse the full costs if employees have already undergone the examinations at their own expense.

4. Compliance Measures and Implementation Procedures for Businesses

To avoid legal risks and additional penalty costs, human resources and occupational safety management departments should implement the following steps:

  • Step 1: Review the employee roster: Clearly classify general employees and employees performing heavy, hazardous or dangerous work, or those falling into special categories, in order to establish health examination schedules of once or twice a year.

  • Step 2: Select a duly qualified healthcare facility: Enter into a contract with a healthcare facility that meets the eligibility requirements prescribed by the Ministry of Health to ensure that all mandatory examination items are covered, particularly obstetric and gynecological examinations for female employees.

  • Step 3: Submit reports on time in accordance with local requirements: Based on the location of the business's head office or branches, compile the relevant documentation and submit reports within the prescribed deadlines (either through direct submission or via the online portal, as required by each province or city).
