Project Overview: 

EnviX – Enviapac's consulting team conducted a chemical substance regulatory compliance audit for a Japanese industrial chemical trading company in Vietnam. We provided a comprehensive and updated compliance checklist covering the latest regulations in the chemical substances field, tailored to the client's activities involving the import, export, trading, purchase, sale, storage, and transportation of chemicals.  

Specifically, we collected and pre-reviewed the client's chemical management information and documentation (including trading qualification certificates, trading licenses, import permits, chemical list, SDSs, chemical label, annual chemical activity reports, etc.). 

Additionally, we conducted an on-site assessment at the client's headquarters office over a 0.5-day period, performing detailed reviews of relevant documents and interviews with responsible personnel and managers. Following the audit, we provided the client with a consolidated audit report, identified non-compliance issues, proposed improvement plans, and offered consulting support and Q&A assistance regarding related questions. 

Value for customers 

The scope of the assessment focused on chemical substance regulations, covering not only customers' direct activities such as import/export, sales, and purchasing, but also activities performed by subcontractors, such as the storage of outsourced chemicals and the transportation of chemicals (hazardous goods). This enabled customers to comprehensively evaluate compliance status both internally and among their suppliers. 

The assessment period addressed numerous chemical substance regulation updates occurring from 2024 through early 2025. Specifically, these included the Chemicals Law (06/2007/QH12), Decree 113/2017/ND-CP (partially amended by Decree 82/2022/ND-CP), and Circular 32/2017/TT-BCT (partially amended by Circular 17/2022/TT-BCT). Furthermore, the compliance checklist updated numerous new regulations promulgated after 2024, including: 

  • Decree 33/2024/ND-CP (Manufacture and Trade of Scheduled Chemical Substances) 
  • QCVN 05A:2020/BCT/SD1:2024 (Amendment to the National Technical Standard on Safe Storage and Use of Hazardous Chemicals) 
  • Decree 161/2024/ND-CP (Regulations on Transporting Dangerous Goods on Roads) 
  • Circular 23/2024/TT-BCT (Management and Use of Industrial Explosives and Explosive Precursors), etc. 

At the time of the audit, many regulations had just come into effect, and there were also transitional provisions applicable from 2025. Furthermore, updates and information were shared regarding new aspects of the draft amendments to the Chemicals Law, which were under development at the time of the audit. 

Unlike on-site factory audits, compliance assessments at chemical trading companies focus on detailed document and record reviews, including: 

  • Chemical lists, Safety Data Sheets (SDS), and labels 
  • Import/export, trading license and notifications 
  • Chemical accident prevention and response plans/measures 
  • Chemical classification and labeling 
  • Chemical safety training documentation 
  • Annual chemical substance activity reports 
  • Documents related to chemical warehouses and transporters, etc. 

This project enabled the clients to systematize their current management practices and update them to the latest legal requirements. Simultaneously, it provided extensive consulting aimed at improving internal management and strengthening interdepartmental coordination regarding compliance with Vietnam's current chemical substance management regulations.
